Formel D GmbH and Formel K GmbH (“Formel D”) take the protection of personal data (“PD”) very seriously and follow the data protection rules. PD are collected on these websites only to the extent necessary. Under no circumstances will the collected data be given to third parties without your knowledge or a known legal reason. The following notice gives you an overview of which data are collected by Formel D during your visit to their websites, for what purpose and how they are used.

Legal Basis for the Process

Insofar as we obtain your consent for the processing of PD, Art. 6 Par. 1 lit. a of the EU General Data Protection Regulation (“GDPR”) serves as the legal basis.

Where the processing of PD is necessary to fulfil a contract, to which you are the contracting party, Art. 6 Par. 1 lit. b GDPR serves as the legal basis. This also applies to processing procedures necessary to carry out activities in response to your pre-contractual inquiries.

Insofar as the processing of PD is necessary to fulfil a legal obligation that applies to Formel D, Art. 6 Par. 1 lit. c GDPR serves as the legal basis.

In the event the processing of PD is necessary to protect the legitimate interests of Formel D, Art. 6 Par. 1 lit. f GDPR serves as the legal basis.

Deletion of Data / Duration of Storage

Your PD are deleted or blocked as soon as the reason for their storage has passed. Apart from this, storage may be carried out if this is allowed by European or national legislators under statutory EU regulations, laws or other rules, which apply to Formel D or an associated company as defined under Sec. 15 et seq. German Stock Corporation Act (“Associated Company”). Blocking or deletion of PD will also take place, once the given storage period under the stated standards has expired, unless further storage of the PD is necessary to conclude or fulfil a contract.

Getting in Contact

Formel D provides you the opportunity to use the website to inform yourself concerning any questions to do with Formel D or to get in contact. You have the opportunity to make contact with Formel D using the contact form, by calling or by arranging a callback. In connection with your contact, data such as your name, email address and telephone number are recorded. Such data are also PD. Processing of these PD is carried out in the context of consent under Art. 6 Par. lit. a GDPR, which is necessary to provide the offered service. The PD will eventually be deleted, as long as they are not still required to fulfil a contract or for pre-contractual activities. Insofar as the work of Associated Companies or businesses run by Formel D is obtained, and this is necessary for the efficient handling of the inquiry, your PD may passed on to such businesses.

Alternatively, contact may be made via the email address supplied. In this case, the PD transmitted by the user in the email will be stored.

Download

Formel D offers the opportunity to download current press releases and Formel D Group’s customer magazine from the website. In the course of the download, the following PD are processed: Browser type / version, operating system used, name and URL of the accessed file, host name of the accessing computer (IP address) and date of inquiry to the server. Connection back to particular persons using these is not possible for Formel D. Combination of these data with other data sources is not undertaken. The storage and processing of these data is done exclusively for system security and the optimization of the Internet offer. The log files are deleted after seven days at the latest.

The legal basis for processing your PD when using cookies is Art. 6 Abs. 1 lit. f GDPR.

Career Portal / Applications

Using Formel D’s homepage, it is possible to apply for vacant positions or submit an unsolicited application. In this case, the following data are processed: Contact details, CV / résumé information, qualifications, sundry information (e.g. salary expectations).

The legal basis for this process is consent under Art. 6 Par. 1 lit. a GDPR, without which the processing of an application cannot take place.

Cookies

For data collection and storage, we employ so-called cookies. Cookies are small packages of data that we ask your browser to store on your computer. These cause it no damage there. They contain no viruses and do not allow us to spy on you. There are two types of cookies used. Temporary cookies are automatically deleted upon closure of your browser (session cookies). Permanent cookies, by contrast, have a longer lifespan. These types of cookies make it possible for you to be recognized when you re-visit the website after leaving it. With the help of cookies, it is possible for us to understand your usage pattern for the abovementioned purposes and the corresponding scope. The following information shall give you a detailed overview on the specific data processing regarding the use and operation of our Facebook fan page.

  • Purpose and legal basis of the data processing
    We use Facebook to attract more attention to our offers and to stay in touch with our customers. Facebook is a web-based platform of Facebook Ireland Limited, headquartered in Ireland, and was developed to operate a social network. In operating a page on the Facebook platform, we process the following statistical user data:
    • Page activities and interaction (the total number of individual persons who have interacted with the page, categorized by type of interaction such as “Like” entries or interactions on the page, the number of page recommendations, the number of clicks on the contact information, and the call-to-action button on the page).
    • Post and page reach (the total number of individuals who have seen the site and the posts).
    • Page preview (the number of people who clicked on the page name or profile picture to see a preview of the page content).
    • Visits (page and tab views, number of visits from a Web page other than Facebook).
    • Interactions with videos (number of views, the videos viewed most for at least three seconds on the site). Information about the users (information about the persons who like the site: gender, age, location, and language; display of persons for whom specific posts have been posted in the last 28 days; display of the persons who commented on, shared, or tagged posts with “Like”; display of persons who have interacted on the site.
    These statistics are generated and provided by Facebook. As the operator of the fan page, we have no influence on the creation and display of the statistics. We cannot turn off this function and cannot prevent the generation and processing of this data. As part of utilizing Facebook Page Insights, we are jointly responsible with Facebook for data processing on the Facebook fan pages pursuant to Article 26 GDPR. With the amendments to the Facebook Terms of Service dated September 11, 2018, Facebook agrees to assume primary responsibility for the processing of Insight data in accordance with the GDPR.     We use the statistics provided by Facebook to make posts more attractive and effective.     Within the scope of a legitimate interest, we process your data for the purposes of:
    • Providing a communication channel and advertising for our products and services
    • Facebook uses so-called cookies - small text files that are stored on the various end devices of the users - to store and further process this information.
    If the users have a Facebook profile and are logged in to it, the storage and analysis also takes place across devices. This data processing is carried out in accordance with the principle of data minimization and in pseudonymized and/or aggregated form to the extent possible.

Security

Formel D can accept no liability for the transfer of data over the Internet. Transmissions via email are not encrypted. Disclosure to third parties can therefore not be ruled out. It is therefore recommended confidential information be sent exclusively by post.

Rights of Data Subjects

If your personal data are processed, you are a data subject under the terms of the GDPR and you have the following additional rights with respect to us. Please always send your requests to the abovementioned Controllers.

Information: You have the right to ask us at any time, free of charge, for information and confirmation concerning any PD that we hold about you and to receive a copy of this data.

Correction: You have the right to correct and/or complete the PD processed, insofar as these appear to be incorrect or incomplete.

Limitation of Processing: You have the right to request a limitation of processing, if one of the following conditions is met:

  • The accuracy of the PD is disputed by you, when we have been given the time to check the accuracy of the PD.
  • The processing is unlawful, you decline to have the personal data deleted but ask instead for the use of the PD to be limited.
  • We do not need the PD for processing purposes any longer, however you need them for assertion, exercise or defense of legal claims.
  • You have lodged an objection to processing under Art. 21 Par. 1 GDPR but it is still not certain whether our legitimate interests outweigh yours.

Deletion: You have the right to have PD that apply to you deleted without undue delay for any of the following reasons and insofar as processing is unnecessary:

  • PD were collected for such purposes or processed in such ways, for which they are no longer required.
  • You revoke your consent, upon which the processing relies, and no other statutory reason exists for the processing.
  • You lodge an objection to processing under Art. 21 Par. 1 GDPR and there exist no higher priority interests for the processing, or you lodge an objection to processing under Art. 21 Par. 2 GDPR.
  • The PD were unlawfully processed.
  • The deletion of PD is necessary to fulfil a legal obligation applying to us under EU law or the law of the member states.
  • The PD were collected in connection to services offered by information companies under Art. 8 Abs. 1 GDPR.

Data Portability: You have the right to receive PD applying to you, which you have already given us, in a structured, accessible and machine-readable format. In addition, you have the right to transfer such data to another controller without our interference. In exercising this right you have the further right to ask us to send the PD that apply to you directly to another controller, insofar as it is technically feasible. The freedoms and rights of other individuals may not be affected by this.

Objection: You have the right to lodge an objection at any time against the processing of PD that apply to you, which is “only” carried out for reason of our legitimate interests or those of a third party (Art. 6 Par. 1 lit. f GDPR). In the event of an objection, we may not process PD any further, unless we can demonstrate compelling interests for the processing worth protecting, that outweigh your interests, rights and freedoms, or the processing serves the assertion, exercise or defense of legal claims.

Revocation of Consent: You have the right to revoke your declaration of consent under data protection law at any time. In the event of revocation of consent, the lawfulness of processing that took place by reason of consent until its revocation remains unaffected.
